1. Who we are

This website is operated by StratifyFX (Pty) Ltd, a company registered in South Africa (“StratifyFX”, “we”, “us”). You can reach us at info@stratifyfx.co.za. By creating an account or using this website you agree to these terms. If you do not agree with them, please do not use the website.

2. What StratifyFX is — and what it is not

StratifyFX is a private online trading community. Membership gives you access to educational discussions, market commentary, community conversation, live sessions and trading-related content and software shared within the community.

StratifyFX is not a financial services provider, financial advisor, portfolio manager, broker or investment manager. Nothing on this website is financial, investment, tax or legal advice. We do not manage money, we do not hold client funds, we do not execute trades on your behalf, and we do not know your personal financial circumstances, objectives or risk tolerance.

Any commentary, market observation, chart, idea, indicator, script or piece of software made available through StratifyFX is shared for educational and informational purposes only. It is general in nature and is not a recommendation or an inducement to enter into any transaction. Every decision you make in your own trading account is yours alone.

3. Membership and accounts

Membership is personal to you. You must give accurate information when you sign up, keep your password secure, and not share your login with anyone else. You are responsible for everything that happens under your account.

Free membership requires a trading account opened with, or transferred to, our partner broker under our introducing broker relationship, and is subject to our verification of that account. We may decline, pause or withdraw membership at our discretion, including where the underlying broker account is closed, becomes inactive, or was never verified.

You must be at least 18 years old to hold a membership.

4. Introducing broker relationship — how we earn

StratifyFX is an Introducing Broker for XM. Where you open or transfer a trading account under our partner link or partner code, we may receive compensation from the broker based on the trading activity in that account. This is standard in the industry, it costs you nothing extra, and we are telling you about it so that you can weigh it up. It does, however, mean we have a commercial interest in members trading, and you should read everything we share with that in mind.

5. Paid membership, billing and cancellation

Where paid membership is available, it is billed monthly in advance in South African Rand. There is no free trial. You may cancel at any time, and your access continues until the end of the period you have already paid for. We do not provide pro-rata refunds for part-months.

We may change pricing on reasonable notice. Changes will not affect a period you have already paid for.

6. Software, indicators and licences

Software made available to members — including indicators, expert advisors and scripts — is licensed to you personally for the duration of your membership. It is not sold to you and you do not own it. Licences may be locked to a single trading account number and are not transferable.

You may not copy, redistribute, resell, publish, decompile, reverse engineer or share this software with anyone, inside or outside the community. Doing so ends your membership immediately and without refund.

Software is provided “as is”. Automated tools can and do fail, including because of platform outages, connectivity problems, broker conditions, market gaps and slippage. You are responsible for monitoring anything running on your own account.

7. Community conduct

Live sessions, chats and channels are shared spaces. Do not harass other members, do not solicit or promote other services, do not share other members’ personal information, and do not record or republish private sessions. We may remove anyone who does.

8. No guarantee of results

We do not promise profit, income, or any particular outcome. Any past result, example, screenshot or statistic shown anywhere on this website or in the community describes what has happened before and is not a reliable indicator of what will happen next. Please read our risk disclosure.

9. Availability

We aim to keep the website and sessions running, but we do not guarantee uninterrupted availability. Features may change, be added, or be withdrawn. Scheduled sessions may occasionally be moved or cancelled.

10. Limitation of liability

To the fullest extent permitted by South African law, StratifyFX is not liable for any trading losses, lost profits, lost opportunity, or any indirect or consequential loss arising from your use of this website, the community, or any software or content obtained through it. Nothing in these terms limits liability that cannot lawfully be limited, including liability for fraud or for death or personal injury caused by negligence.

11. Ending your membership

You may close your account at any time by contacting us. We may suspend or end a membership where these terms are broken, where verification fails, or where required by law. Licensed software stops working when a membership ends.

12. Changes to these terms

We may update these terms. Where a change is material we will tell members before it takes effect. Continuing to use the website after that point means you accept the updated terms.

13. Governing law

These terms are governed by the law of the Republic of South Africa, and the South African courts have jurisdiction.

Please read this. These terms have been drafted as a starting point and have not been reviewed by an attorney. Before relying on them, StratifyFX should have them checked by a South African lawyer — in particular on where the community sits in relation to the Financial Advisory and Intermediary Services Act (FAIS) and FSCA licensing, given that trading ideas and automated trading software are made available to members.
